These General Conditions apply, without restriction or reservation, to sales of Finca Rodma products made through the website www.fincarodma.com (hereinafter, the “Website” or “Website”).

The sale of products through this Website is carried out under the name FINCA RODMA by Grupo Valdecuevas Agro, SLU, a Spanish company domiciled in Valladolid, at Plaza Martí y Monsó 5, 1º, Postal code 47001, registered in the Mercantile Registry of Valladolid, in Volume 981, Folio 118, Sheet VA-13223 with CIF number B47027982.

Through its site www.fincarodma.com, Finca Rodma provides information about its products and offers the opportunity of purchasing them In any event, there are pages on the Website accessible to individuals or legal entities who do not register or initiate a product purchase, whilst being subject to the terms and conditions set forth in these General Conditions, to the extent that they may be applicable. Finca Rodma wants to make it known that it is aimed exclusively at an audience of over 18 years of age and that the territory in which it accepts and distributes orders is the European Union (hereinafter, the “Territory”).

These General Conditions of sale are accessible at all times from the Website and will prevail over any other document with which they contradict, without prejudice to current legislation.

The validation of the purchase order by the customers of www.fincarodma.com (hereinafter, the “Customer”) implies, without any reservations, the acceptance of these General Conditions of sale. If these General Conditions of sale are modified, the new General Conditions will be binding for all purchases made after their publication on the Website.

YOUR DATA AND YOUR VISITS TO THIS WEBSITE

The information or personal data you provide to us will be processed in accordance with the Privacy Policy and Cookie Policy.

REGISTRATION AS A USER

The Customer, previously or during the course of an order, may register as a “User”. In this case, to make a purchase he/she must provide the information necessary to register if it is the first order or, where appropriate, identify himself/herself if he/she already owns an account.

The information necessary for registering as a User is: name, surname, billing address, telephone number, e-mail address, username, and password.

Finca Rodma also offers the opportunity to make purchases of its products through the Website without the need to register as a User, providing only the necessary data for the purchase and delivery of the products.

PRICES

All the prices of the products that are indicated through the Website include VAT and any other taxes which may correspond. However, these prices do not include the costs corresponding to the shipment of the products, which are detailed separately and must be accepted by the Customer in the purchase process.

The prices shown may be revised and modified if conditions require at any time. The products are served according to the rates in force on the Website at the time of order registration.

AVAILABILITY

Finca Rodma will do everything possible to satisfy all its customers in the demand for the products. However, on occasions, and due to circumstances reasonably beyond the control of Finca Rodma, such as human error or incidents in the computer systems, it is possible that the product may not be available after the order has been placed, in which case the Customer will be informed by email of the total or partial cancellation of the order. Partial cancellation of the order due to lack of availability does not grant the right to cancel the entire order. If, as a result of this cancellation, the Customer wants to return the delivered product, he/she must follow the provisions set out in the “Return” section.

PAYMENT

The Customer agrees to pay at the time the order is placed. On top of the initial price that appears on the Website for each of the products offered, the corresponding rates will be added to the relevant shipping costs. In any event, these rates will have been previously communicated to the Customer before formalizing the purchase itself. The ticket, order or proof of purchase that corresponds to the order will be available and will be sent by email to the address provided by the Customer. The Customer must pay the amount corresponding to his/her order by means of payment by credit or debit card (Visa, Mastercard, American Express, Visa Electron and / or other similar cards), it is also possible to pay by Paypal system. The Customer must notify Finca Rodma of any undue or fraudulent charge on the card used for purchases, by email or by telephone, in the shortest time possible so that Finca Rodma can carry out the appropriate procedures.

ORDER PROCESSING

Once the order is processed, that is, on the acceptance of the General Conditions and the confirmation of the purchase process, Finca Rodma will always send an email to the Customer confirming the details of the purchase made.

CANCELLATION

Finca Rodma will accept order cancellations when requested before the end of the day the purchase is made. Finca Rodma will only accept order cancellations when they are requested WITHIN THIS PERIOD. To make the cancellation, the Customer must SEND an email to info@fincarodma.com, requesting the cancellation of his/her order and attaching the purchase order to guarantee ownership of it. Outside this period or once the purchase has been sent, order cancellations will not be accepted given the personal nature, purpose and destination of the products sold.

DEADLINES, PLACE OF DELIVERY AND LOSS

1. Product delivery.
   Finca Rodma undertakes to deliver the product in perfect condition to the address indicated by the Customer on the order form and which, in any event, must be within the Territory In order to optimise the delivery, please provide an address to which the order can be delivered during normal working hours. The order will be delivered by hand and under signature, if the Customer is not at home at the time of delivery, the transport company will leave a notice for the Customer to contact him/her and agree on a new delivery date or a place for collection of the order. The rates charged by default on the Website are those set by the transport company. Finca Rodma will not be responsible for any errors caused in delivery when the delivery address entered by the Customer on the order form does not correspond to the real address or data has been omitted.
2. 2. Delivery Period.
   The products have a delivery period of between 1 and 2 business days within the Iberian Peninsula and 3 to 5 business days in the rest of the Territory, these terms are average, and therefore an estimate Therefore, it is possible that they will vary for logistical reasons or force majeure. In cases of delays in deliveries, Finca Rodma will inform its customers as soon as it becomes aware of them. Each delivery is considered completed from the moment in which the transport company makes the product available to the Customer, which is implemented through the control system used by the transport company. In the event of delays in the delivery of orders attributable to Finca Rodma, the Customer may cancel his/her order in accordance with the procedure described in the “Return” section. Delays in delivery will not be considered those cases in which the order has been made available to the Customer by the transport company within the agreed period and could not be delivered for reasons attributable to the Customer.
3. Delivery Data, Deliveries not made and Loss.
   If at the time of delivery, the Customer is absent, the transport company will leave a notice for the Customer to contact it and agree on a new delivery date or place for collection of the order. If after 7 working days from the delivery of the order, the delivery has not been arranged, the Customer must contact Finca Rodma. If the Customer does not do so, the order will be returned to our warehouses 15 working days after the order has been dispatched and the Customer will be responsible for the shipping costs and the cost of returning the goods to their origin, as well as any associated administrative costs. If the reason for non-delivery is that the package was lost, the transport company will initiate an investigation. In these cases, the response times of our carriers usually oscillate between one and three weeks.
4. Diligence in delivery.
   The User must check the proper condition of the requested product package at the same time the order is received. If, once the package has been checked, the Customer detects any incident such as a blow, breakage, signs of having been opened or any damage caused to it by shipping, he / she may refuse to accept the order, stating this circumstance. The transport company will notify Finca Rodma and after verifying the damage, the order will be replaced, or the amount of the order will be refunded to the Customer according to his/her preference.

 

REFUND

The Customer has a period of 14 calendar days to return, at his/her cost, the products which are not to his/her satisfaction. This period is counted from the day of delivery of the package to the Customer. Finca Rodma will only accept returns that meet the following requirements: 1. The item must be in the same condition in which it was delivered and have its original packaging and labelling. 2. The shipment must be made using the same box or envelope with which the product was delivered, or failing that, in a similar format that guarantees its return in perfect condition. 3. A copy of the delivery note / invoice must be included in the package, where the returned products and the reason for the return are also marked. In order to make the return process easier for customers and to be able to track it correctly, if the reason for the return is attributable to Finca Rodma (the product is defective, it is not the one that was ordered, etc.), the use of this service is free of charge. If there is another reason (the products were served correctly but they are not to your liking), Finca Rodma will pay the cost of the products except for the shipping costs which will be deducted from the refund depending on the cost in each case. To proceed with the return, the Customer must communicate this by email to info@fincarodma.com indicating in “subject” CANCELLATION ORDER NO. and specifying the products that he/she wants to return within the return period. You can also communicate by phone at 983 074 077. Finca Rodma will contact the Customer as soon as possible.

INTELLECTUAL AND INDUSTRIAL PROPERTY

Finca Rodma holds all rights over the content, design, and source code of this website and, in particular, including but not limited to, the pictures, images, texts, logos, designs, trademarks, trade names and data included on the website. Please note that these rights are protected by current Spanish and international legislation on intellectual and industrial property. Similarly, and without prejudice to the foregoing, the content of this website is also considered to be a computer programme and, therefore, all current Spanish and European Community legislation on the subject is also applicable to it. The total or partial reproduction of this website, even by means of a hyperlink, or of any of its contents, is expressly prohibited without the express written permission of Finca Rodma.
